California Senate Bill – SB1160

June 9, 2017 – California Senate Bill – SB1160 enacted last fall requires lien holders to file declarations on liens filed from January 1, 2013 through December 31, 2016. The declaration confirms the provider or the lien owner has documentation that the filed lien meets certain regulatory requirements. The lien cannot be a balance subject to Independent Medical Review or Independent Bill Review. Documentation of prior authorization but failure to pay or documentation that medical treatment has been neglected or unreasonably refused to the injured worker are the most common reasons to justify filing the declaration. Maximum Medical in conjunction with contractors, investors, and EAMS filers has filed over 30,000 declarations to keep liens active prior to the upcoming deadline of June 30, 2017.
